Modern estates are rarely straightforward. With increasingly diverse family structures and assets often held across multiple jurisdictions, probate matters have become significantly more complex than in previous generations.
We recently assisted clients acting as Executors of a relative’s estate which included foreign-held assets. While international elements often bring additional legal considerations, in this instance the complexity arose from a breakdown in family relationships. A dispute developed between beneficiaries regarding the distribution of the estate, placing significant pressure on the appointed Executors.
We supported the Executors throughout the process, ensuring they understood their legal responsibilities and had the appropriate professional guidance. Recognising the emotional strain on the family, we referred them to a trusted Mediator in an effort to resolve the matter outside of court.
Following the mediation, we prepared a Deed of Variation to reflect the terms of the settlement agreed by all parties. This allowed the estate to be distributed in a way that acknowledged each family member’s position, while still respecting the wishes expressed in the Will.
Although we cannot remove the emotional weight of a family dispute, our experience in handling contentious probate and complex estates enabled us to guide our clients through a difficult process with clarity and reassurance.
